Litigation Issue
This Agreement is entered into in the state of Washington and shall be governed by, and construed in accordance with, the laws of the Sate of Washington, exclusive of its choice of law rules. Each party to this Agreement submits to the exclusive jurisdiction of the Sate and Federal courts sitting in the Snohomish County in the City of Everett, in the State of Washington, and waives any jurisdictional, venue, or inconvenient forum objections to such courts. Each party to this Agreement further agrees as follows: 1. any claim brought to enforce this Agreement must be commence within one (1) year of the cause of action accruing; 2. no recovery may be sought or received for damages other than out of pocket expenses, except that the prevailing party will be entitled to costs and attorneys' fees; 3. any claim must be brought individually and not consolidated as part of a group or class action complaint.

Policy for Placing an Order
1. Chose product type. Taxes will only be charged on merchandise shipped to Washington State at the rate of 8.6 percent. This rate is subject to change without notification.

3. Simply click "Add to Cart" to add any desired items to your shopping cart that you wish to purchase.
At any time in the process you can review what you have in your shopping cart by clicking on "Shopping Cart." If you have certain items in you cart and you wish to keep shopping simple click on "Continue Shopping." There will be a quantity box "QTY" for you to indicate the number of the particular item you desire. There is an "update" and "Remove" button to allow you to remove or add items to or from your cart and/or change quantities.
4. When you are ready to proceed with your order, you will need to Click on to the "Method of Shipping" selecting how you want you items shipped. If you are using a "gift certificate" or "gift card" you would need to enter the code provided on the gift certificate/gift card in the Gift Card Code box provided just above the "Checkout" button. Once you are satisfied with you item selections and shipping method, just click on "Checkout". After you have made that selection and clicked on "Checkout", your order, shipping charges and any applicable taxes will automatically show in the itemized list of charges with total for your order. The shipping cost will also show on the previous order page when you select a shipping method, standard, domestic priority, First Class International or priority international (shipping cost will show in box). Next to your total charges you will have a "Continue Shopping" button" should you decide to do additional shopping after a review of your items in the cart and total charges.
5. Enter your shipping information. Please note that you will receive an Order Confirmation email which contains pricing information; however, the actual shipment does not. You will need to choose one of the Payment Methods: Pay by Mail, PayPal or Pay Online (Credit Card). Depending on the method of payment you choose additional information steps may be required. Make sure you have read and agree to "Terms of Sale" and checking the "Yes" box.
6. Verify the Shipping Information and items in your cart carefully. If you need to make changes, click your web browser's "back" button to return to the previous form. If and when it is correct, click "Submit."
7. On the next page, "Please Confirm Your Purchase," verify your desired Shipping Options, and, if appropriate, enter any Gift Certificate or Coupon Code you have. Click "Next."

You can also place your order on our Website using our pay by mail option which enables you to complete your order on-line and mail your payment to us. Please note that we do not secure inventory and/or begin processing your order until we receive your payment and the funds have cleared. This option is only available for orders shipping to the United States. *Orders paid with personal check will encounter significant delays, as those funds must be cleared to BMP and BMP must be notified accordingly. Only and only then will orders enter the processing stage. Payments by personal check for orders shipped outside the United States will not be accepted.

Once you are completed and satisfied with the process, we suggest you print a copy of the page with your confirmed Order number (#) and items. You will receive a confirmation email once your order has been submitted.
NOTE: Butterfly Music Productions has the right to refuse and/or cancel any order for any reason, or no reason, without previous notice. If any monies have been accepted on any such orders, the monies will be refunded in the exact amount collected.

Duties and Taxes
You may be subject to import duties and taxes, which are levied once a shipment reaches your country. Any additional charges for customs clearance are your responsibility; we have no control over these charges and cannot predict what they might be. Furthermore, to our international customers, you should be aware that cross-border shipments are subject to opening and inspection by customs authorities.
For orders shipped to anywhere in the United States except Washington State there will be no State sales tax, unless otherwise specified. Orders shipped to Washington State will be subject to an 8.6 percent sales tax. This tax is subject to change without advanced notice.

Domestic and International Pricing
Butterfly Music Productions computes local currency prices for all items using competitive exchange rates. The local currency total displayed in your shopping cart is figured as the sum total of the US dollar prices for each item ordered, and then converted to your currency. Occasionally, this amount may vary from the sum of the individual local currency prices of the items listed in your shopping cart, because of rounding differences that arise when converting the figures.
We do not, at this time, offer COD, wire or bank transfer, and/or any other options not noted.

Order Processing & Delivery Expectations
Depending on the combination of the items you order, the order processing time will vary. In an attempt to maintain competitive shipping rates, we will ship all similar items in one shipment. If a particular item is out of stock and/or unavailable, the rest of the order will be held up until such time as the whole order is available. When the rest of the order arrives in stock, in our possession, we will ship your entire order to you in one shipment. Delivery orders do not include weekends.
NOTE: In the event that the artist is unavailable, signed items could be delayed significantly longer depending on the nature of the delay and availability; however, if signed items are readily available and on hand the processing time could be as projected within the table of "Average order processing times"

4. Do you accept PayPal?
Yes, we do. Simply select the PayPal option when making payment using your PayPal account. This option is only available on orders totaling less than $250.00.
5. Do you accept, COD, or wire transfers?
No. At this time we only accept credit card (Master Card, Visa, American Express and Discovery) and money orders, cashiers checks or *personal checks drawn from US banks and payable in US dollars.
6. How do I use a gift certificate or coupon?
You can use a gift certificate or coupon with mail in orders only (unless provided with a website code). Gift Certificate codes can be utilized for online orders at check out by entering the website code in the proper place and following any and all gift certificate rules as outline in this agreement. You must mail a copy of your email certificate with your completed order form and any additional payment, if applicable, to the address provided for mail in orders. If it is a website coupon and/or advertised promotion, you may be able to enter the code word and/or number into the box provided for codes to trigger the promotion. Any promotions and/or gift certificate and/or gift card must be activated at the time of the order. If a promotion is not activated at the time the order is placed, you have lost the benefits of any said promotion and or the opportunity to utilize any and all gift certificates and/or gift cards for said order. A gift certificate purchase can be made that exceeds the amount of the gift certificate, as long as the, additional amount of money due is paid at the time of the order. Any orders received that exceed the amount of the gift certificate without the additional payment of the remaining balance, at the time of the order, will not be accepted.
Balances will not be carried forward on any gift certificate. If a purchase is made that is less than the amount of the gift certificate, any remaining amount on the gift certificate will not be redeemable, under any circumstances.
NOTE: Gift Certificates - Butterfly Music Productions is not in any manner, responsible for the security and utilization of any and all gift certificates once they have been purchased. If gift certificates have not been used within one year from the date of purchase, any and all gift certificates forfeit any and all remaining value that was on them at the time of their expiration and is no longer redeemable. BMP will only release merchandise for gift certificates when an order is accompanied by a copy of the gift certificate from the individual the gift certificate is assigned to. For online orders this will require entering the proper gift certificate code in accordance with the terms of this agreement at the time of said order. BMP takes no responsibility for any misuse of any gift certificate by anyone other than the individual who owns the gift certificate. Under no circumstances will BMP pay out cash or any other form or payment other than available merchandise currently available on BMP's website at the time of purchase. Gift Certificates can only be used with Mail in orders and a copy of the gift certificate must accompany the mailed in completed order form (unless provided with a website code). Gift Certificates can not be used to purchase other gift certificates.
7. How will I know when my order ships?
When your order ships, we will email you a Shipping Confirmation. If tracking service is available, we will include the Tracking or Airway Bill number in your Shipping Confirmation email. If you do not receive a tracking or Airway Bill, then tracking service is not available for your package.

Tracking Your Shipment
When your order ships, we will email you a shipping confirmation. If tracking service is available, we will include the tracking or Airway Bill number in your Shipping Confirmation email. If you do not receive a tracking or Airway Bill number in your Shipping Confirmation email, then tracking service is not available for your package.
We currently use the US Postal Service to ship our products.

Return Policy and Instructions
Any items purchased on this website are not returnable under any circumstances, unless the shipment contains something other than specified on the order form and/or damaged in the mail. The only available remedy for this will be upon notification of said error in shipping and/or damaged merchandise, BMP will replace the incorrect or damaged merchandise upon it's return. The same time tables apply, as for the original order for shipping. There are no returns on merchandise.
To return any damaged items please place the item(s) in the original (or if damaged, comparable) tube or box and return to BMP.
